Terms & Conditions of Service
1. Booking, Deposits, and Cleared Funds
To secure a reservation, a deposit is strictly required at the time of booking. The full remaining balance must be paid 30 to 60 days before the tour's commencement date. To prevent fraudulent transactions, a booking is only legally binding once funds have successfully cleared into Unitouch Tours & Travels' accounts via approved credit card, electronic transfer, or SWIFT.
2. Cancellation Penalties and No-Shows
All cancellation requests must be submitted in writing and actively acknowledged by our team to be considered valid. The following standard penalties apply to the total package price:
- More than 90 days before departure: 10% forfeiture.
- 89 to 30 days before departure: 35% to 50% forfeiture.
- Less than 30 days before departure: 100% forfeiture.
No refunds will be issued for "no-shows," declined alternative services, or leaving a tour before completion.
3. Fraud Prevention and Anti-Money Laundering
Any booking identified as speculative, false, or fraudulent will be cancelled immediately without prior notice. For authorized cancellations where a refund is due, the funds will strictly be routed back to the original method of payment to prevent financial fraud, minus any applicable administrative fees (typically 5-10%), bank charges, and currency exchange fees.
4. Force Majeure and Exemption of Liability
Unitouch Tours & Travels accepts no liability for tour alterations, delays, or cancellations caused by events beyond our reasonable control, including but not limited to pandemics, natural disasters, impassable roads, government park closures, or airline schedule changes. In such Force Majeure events, we will request the guest to accept a non-refundable travel credit note valid for up to 24 months rather than a cash refund.
5. Governing Law
These terms, conditions, and the relationship between the client and Unitouch Tours & Travels are strictly governed by the laws of the Republic of Kenya. The courts of Kenya shall have exclusive jurisdiction over any claims or disputes.
